Public Procurement Law

In the area of public procurement, we advise public principals on the preparation of domestic and European call for bids. We address basic issues such as the applicability of German construction-contract procedures (VOB/A, VOL/A, VgV) and assist the principal in the drafting of the tender documents. Of course, we also render legal advice in the awarding proceedings, e.g. as to inquiries or objections from the bidders.

Furthermore, we offer comprehensive advice on awarding law issues affecting the recipients of public subsidies, who – as a rule – are less familiar with public procurement law. Nevertheless, the General Collateral Clauses on Subsidies (ANBest) obligate them to call for bids in line with the domestic public procurement regulations under the VOB/A respectively VOL/A. 

We advise corporations on all awarding issues, and the drafting of the tender documents; we support the bidders in case of inquiries with the awarding office, with the preparation of their offer, and – as the case may be – the handling of objections. 

Eventually, we efficiently represent either the principal or the bidder in award re-examination proceedings.

We do not only advise on awards of building and construction works but also on public procurement in application of the VgV or VOL/A (e. g. facility management or IT services), and the award of freelance and artist services according to the VgV.
